To all buyers of EPCDs/explosive pest control devices (Bird Bombs®, Bird Whistlers®, Shell Crackers): The federal regulation of our bird control pyrotechnics has rocked Sutton Ag right to the core. For YOU, we dont want this process to be any more frustrating, intimidating, or expensive than it has to be! In our efforts to dilute those aspects of the regulations, we share below what weve learned since our last letter (posted below) .

||||||||||||||||||||||||||||||||||||||||||
IMMEDIATE RELEASE TO ALL BUYERS OF WILDLIFE CONTROL PYROTECHNICSBeginning May 1, 2011 the US Bureau of Alcohol, Tobacco, Firearms, & Explosives will require all users of Explosive Pest Control Devices (EPCD) to have a federal explosives permit. The application can be downloaded from the ATF website where youll find all the information necessary to help you understand the regulations. You can also contact ATF direct:
Sutton Ag products subject to this requirement are:
The major considerations regarding getting a permit are:
You will need to decide whether to continue using wildlife control pyrotechnics as part of your bird control program. We support the decision you make, and hope to be of service in any event. If you choose to eliminate EPCDs from your bird control program, we look forward to offering you alternative solutions. If you are committed to maintaining access to these products as part of a diversified bird control effort, please contact us for an information packet that we hope will facilitate the application process. The explosives permit application will take up to two months for ATF to approve, so be sure to allow time before your bird damage season arrives. Federal, state, and local agencies are not subject to all of the new regulations (see item (a) 3 here: 27cfr555.141 ), but must maintain proper storage, and can purchase these items after completing and returning a Declaration of Use form to Sutton Ag. |
